1. Introduction

Welcome to Abrifit. These Terms & Conditions ("Terms") govern your use of the Abrifit website and our gym management SaaS platform (the "Service"). Abrifit is a product designed to streamline gym operations, member management, and fitness business analytics.

2. Acceptance of Terms

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a gym or business entity, you represent that you have the authority to bind that entity to these Terms.

3. Eligibility & Account Registration

You must be at least 18 years of age to use the Service. To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.

You are responsible for safeguarding your account password and for any activities or actions under your password. Abrifit cannot and will not be liable for any loss or damage arising from your failure to maintain account security.

4. User Responsibilities

As a user of Abrifit, you agree to:

• Use the Service only for lawful purposes in accordance with these Terms.
• Maintain the accuracy of all data uploaded to the platform, including member records and business details.
• Ensure that your staff and trainers use the Service responsibly and within their authorized permissions.
• Protect the privacy of your gym members and comply with applicable data protection laws in India.

5. Subscription & Billing

Abrifit offers various subscription plans with different features and limits. By selecting a plan, you agree to pay the fees associated with that plan. Subscription fees are billed in advance on a recurring basis (monthly or annually) as per your selection.

6. Payment Terms

Payments are processed through secure third-party payment gateways, such as Razorpay. You agree to provide valid payment information and authorize us to charge all accrued fees to your chosen payment method. All prices are in Indian Rupees (INR) unless otherwise specified.

7. Free Trial & Plan Changes

We may offer a 30-day free trial for new accounts. At the end of the trial period, you must select a paid plan to continue using the full features of the Service. You may upgrade or downgrade your plan at any time; changes will be reflected in your next billing cycle.

8. Refund & Cancellation Policy

You may cancel your subscription at any time through your dashboard settings. Upon cancellation, you will retain access to the Service until the end of your current billing period. Fees paid are non-refundable except where required by law or specifically agreed upon in writing.

9. Acceptable Use Policy

You agree not to:

• Use the Service for any fraudulent, abusive, or illegal activity.
• Attempt to interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer or attempt to extract the source code of the Service.
• Use automated systems (bots, spiders) to access the Service without permission.

10. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. You retain all rights to the data you upload to Abrifit. By using the Service, you grant us a license to host, store, and process your data solely for the purpose of providing and improving the Service.

11. Intellectual Property Rights

All content, features, and functionality of the Service (including logos, software, and AI models) are the exclusive property of Abrifit and its licensors. You may not use our branding or intellectual property without prior written consent.

12. Service Availability

We strive to maintain high uptime and availability for the Service. However, we do not guarantee uninterrupted service. Maintenance, updates, or technical issues may lead to temporary downtime. We will make reasonable efforts to notify users of scheduled maintenance.

13. Limitation of Liability

To the maximum extent permitted by law, Abrifit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Service.

14. Suspension & Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

15. Third-Party Services

The Service integrates with third-party providers such as Supabase (Authentication), Vercel/Railway (Hosting), and Razorpay (Payments). Your use of these services may be subject to their respective terms and conditions.

16. Changes to Terms

We may modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website and updating the "Effective Date." Your continued use of the Service after such changes constitutes acceptance of the new Terms.

17. Governing Law (India)

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in India.
